Von unserem kanadischen Partner Universal Logistics erhielten wir heute Nachmittag die Nachricht, dass auf Drängen der kanadischen Regierung der Arbeitskampf zwischen den kanadischen Eisenbahngesellschaften Canadian National (CN) und Canadian Pacific Kansas City (CPKC) und der kanadischen Eisenbahnergewerkschaft Teamsters Canada Rail Conference durch ein unabhängiges Schiedsgericht verhandelt werden soll.
Beide Bahngesellschaften haben signalisiert, die Aussperrung der Mitglieder der kanadischen Eisenbahnergewerkschaft noch an diesem Wochenende zu beenden. Auch wenn die Bahngesellschaften an diesem Wochenende Ihren Betrieb wieder aufnehmen sollten, wird es sicherlich noch einige Tage dauern, bis der Rückstau abgebaut ist und die Güterzüge wieder im Normalbetrieb laufen.

Railways Prepare to Restart After Federal Government Forces Binding Arbitration in Labour Dispute
Canada’s Labour Minister Steven MacKinnon is intervening to end a work stoppage that saw this country’s two largest railways grind to a standstill Thursday, by forcing the parties into binding arbitration.
MacKinnon said he is invoking powers under Section 107 of the Canada Labour Code to direct the Canada Industrial Relations Board (CIRB) to „assist the parties in settling the outstanding terms of their collective agreements by imposing final binding arbitration.“
MacKinnon has also ordered the board to extend the term on the parties‘ current collective agreements until new deals are signed, and is calling for operations on both railways to resume „forthwith.“

Following Order by Minister of Labour, CN Resumes Train Movements
CN announced yesterday that, effective 18:00 ET, it ended its lockout and immediately initiated its recovery plan.
As CN awaits the formal order from the Canada Industrial Relations Board (CIRB), the company made this decision in order to expedite recovery of the economy.

CPKC Prepares to Restart Railway Operations, Awaits CIRB Order
Canadian Pacific Kansas City (CPKC) yesterday said it is preparing to restart railway operations in Canada following the Canadian Minister of Labour’s announcement that he will exercise his authority under Section 107 of the Canada Labour Code to direct the Canada Industrial Relations Board (CIRB) to impose final binding arbitration and for railway operations to resume forthwith.
CPKC will follow the order of the CIRB once it executes the Minister’s direction. Its teams are already preparing for the safe and orderly resumption of its rail network and further details about timing will be provided once it receives the CIRB’s order.

CPKC said in a note to customers yesterday at 7:30 pm ET that the CIRB had already convened the parties for a case management conference that evening, consistent with the Minister’s stated expectation that the CIRB execute his direction expeditiously.
CPKC Disappointed by TCRC’s Decision to Dispute Minister’s Direction to Resume Railway Operations
In a case management conference convened by the Canada Industrial Relations Board (CIRB) at 9:00 pm ET last night, the Teamsters Canada Rail Conference (TCRC) representing the Train and Engine division and Rail Canada Traffic Controller division refused to discuss resumption of service, said CPKC in a statement. The union said it will make submissions to challenge the constitutionality of the Minister’s direction, as well as the CIRB’s discretion to proceed with any order.
Another case management conference is scheduled for 10:00 am ET today to further hear submissions by the parties.
While the Minister directed that the CIRB proceed expeditiously, any decision by the CIRB on the resumption of service will be delayed. CPKC remains prepared to resume service as soon as it is ordered to do so by the CIRB.

Die kanadischen Eisenbahngesellschaften Canadian National (CN) und Canadian Pacific Kansas City (CPKC) haben nunmehr tatsächlich – wie vorher angekündigt – ab dem 22. August 2024 00:01 Eastern Time alle Bahnmitarbeiter, die Mitglieder der kanadischen Eisenbahnergewerkschaft Teamsters Canada Rail Conference sind, ausgesperrt. Bis die Eisenbahnen und das TCRC zu einer Einigung kommen oder ein verbindliches Schiedsverfahren verhängt wird, sind alle Zugbewegungen innerhalb Kanadas sowie zwischen Kanada und den Vereinigten Staaten eingestellt.
Betroffen von dem angekündigten Streik sind auch die Containerverkehre von und zu den kanadischen Seehäfen der Bahnunternehmen Canadian National (CN) und Canadian Pacific Kansas City Southern (CPKC). Mit gravierenden Auswirkungen auf alle einkommenden Container für kanadische Destinationen wie z.B. Toronto, aber auch für Import-Container, die über Kanada weiter per Eisenbahn in die USA wie z.B. nach Chicago und Detroit transportiert werden, ist zu rechnen.

Canadian rail services shut down as CN, CPKC workers locked out
Canadian National Railway (CN) and Canadian Pacific Kansas City (CPKC) advised early Thursday morning that they had moved forward with their lockout notices and shut down services after negotiations with the Teamsters Canada Railway Conference (TCRC) union failed to reach an agreement. This is the first time that a work stoppage has occurred simultaneously at CN and CPKC, which are responsible for the bulk of Canada’s freight train operations.
The decision, confirmed by the TCRC union representing close to 10,000 workers at the companies, sets the stage for an unprecedented rail stoppage that could badly damage the Canadian economy and have a significant effect on both international and cross-border trade. These two rail lines haul an estimated one billion dollars in goods each day, according to the Railway Association of Canada.
Pressure is mounting for the federal government to intervene to keep these trains moving from business groups, provincial governments and shippers across Canada. Under Section 107 of the Canada Labour Code, the Minister of Labour can refer the dispute to the Canada Industrial Relations Board (CIRB) for binding arbitration and prohibit a strike, lockout or end any ongoing stoppage pending a resolution. Alternatively, the government can also reconvene Parliament and introduce back-to-work legislation.

The freight rail networks of Canada’s Class 1 railroads – CN and CPKC – ceased operating at 00:01 a.m. ET on Thursday, Aug. 22, with the railroads and the Teamsters Canada Rail Conference (TCRC) still gridlocked in their negotiations to reach a new labor contract. The parties reportedly remain at the bargaining table with the urging of Canada’s Labor Ministry, despite the lockouts now in place.
“This decision to halt operations in a planned and phased approach was made to ensure the safety of the network and the communities in which we operate. It is not a decision that was taken lightly. It does, however, enable us to ensure a safe and orderly shutdown and optimize the eventual resumption of services once the labour disruption has ended,” CN said in an Aug. 22 statement.
The TCRC represents about 10,000 workers at CN and CPKC.
The NCBFAA Transportation Committee and Canadian International Freight Forwarders Association (CIFFA) continue to monitor this situation closely for our respective members.
NCBFAA urges its members to stay up to date on logistics challenges associated with this rail strike and the impacts on containerized imports and exports along the U.S.-Canadian border. As many trucks as possible will be pressed into service by Canada’s seaports and shippers to keep as much freight as possible moving while the trains are stopped.

Our hope at NCBFAA and CIFFA is that the Canadian rail strike will be short-lived. Both the Canadian and U.S. economies will suffer from a prolonged Canadian rail strike.

Canadian National (CN) – Teamsters Canada Rail Conference (TCRC) – Negotiations Update, Intermodal Shipping Embargo Schedule
CN is taking steps to protect its network and customer cargo following the Canada Industrial Relations Board (CIRB) decision on August 9 that none of the services provided by the railways are essential by law. CN is planning for the earliest possible date of a work stoppage, which is now August 22 at 00:01 ET. Given the time required to carry out a safe and orderly shutdown of its network and to comply with regulatory requirements of transporting certain commodities, CN is implementing an embargo on specific intermodal shipments. This is in addition to the embargoes on rail security-sensitive materials (RSSM), poison inhalation hazard (PIH) – toxic inhalation hazard (TIH) and time-sensitive commodities issued on August 12.
- CN is embargoing all temperature-controlled intermodal traffic and hazmat traffic across its network, effective August 15. Exact timing is dependent on origin and destination.
- It is embargoing all intermodal traffic destined to all points in Canada from U.S. origins or U.S. interchange, effective August 16 at 00:01 ET.
- The embargo schedule is available at //www.cn.ca/TCRCinfo. Intermodal (domestic and international) origin/destination timing can be found here.
- All U.S.-to-U.S. intermodal shipments will continue to move per normal operations.
This plan is designed to protect supply chains by ensuring the safe staging of commodities and to allow for a rapid and efficient resumption of operations once the threat of an unpredictable disruption has ended. If a settlement is reached or an arbitration process is established, CN will remove embargoes and resume normal operations.

Canadian Pacific Kansas City Southern (CPKC) – Intermodal Shipment Management During Potential TCRC Work Stoppage in Canada
Effective 00:01 local time today, Thursday, August 15, in preparation for a potential work stoppage on August 22, CPKC will not accept any loaded intermodal shipments classified as dangerous goods. This applies at all intermodal facilities for both domestic and international shipments destined to, or originating from, terminals and ports located in Canada. During a potential work stoppage, which could begin at 00:01 on August 22, intermodal terminal gates in Canada will remain open, in so far as practicable and so long as capacity permits.
Outbound shipments from an intermodal terminal in Canada
- Customers will be able to ingate containers until terminals have reached their capacity. Once in-gated at any origin, shipments will not be available for release to customers.
- CPKC will communicate to customers via Fastpass notifications when terminals are nearing capacity to avoid drivers being turned away at the gate. To subscribe to Fastpass notifications, follow this link.
- Private perishable protective service (PPS) equipment and international reefers are excluded and will not be allowed in the terminals should a work stoppage commence. To understand existing cut-offs for PPS equipment, contact your CPKC account manager.
Inbound shipments to an intermodal terminal in Canada
No change to the existing process is currently planned. If a container has arrived at its destination terminal, customers may request delivery or pick up containers from the terminal.
- For shipments that originate in Mexico or the United States and have not reached their Canadian destination in advance of a work stoppage, shipments will not be available for release to customers; they will be held in terminal until furtherance to destination can occur.
- CPKC will not be providing over-the-road train service in Canada during a work stoppage.
CIFFA Updates from Transport Canada Meeting:
- CN: A small managerial workforce qualified in the running trades will finish the orderly shutdown of operations. Some trains will not make it to final destinations but will head to yards and terminals.
- CPKC: Trains still on the network will be moved to yards where they can be staged safely and tied down.
- Transport Canada: Mediators are currently very engaged in the situation.
- Private Motor Truck Council: A lockout/strike will increase the number of trucks on the road, as well as rates to haul. Dangerous goods on trucks increase health and safety concerns.
- Commodities industries and the agriculture sector are concerned about food security and shortages. Without grain, livestock will be endangered. There are already shortages of fertilizer being seen, a week and a half before the potential lockout.
- Even if a strike is averted, impacts are already being felt.
