1. T\u00e9rminos y condiciones generales:<\/h1>\n

Todas las oficinas de NAVIS en Alemania (NAVIS AG Hamburgo, NAVIS Brema GmbH, NAVIS Han\u00f3ver GmbH, sucursal de NAVIS AG Freiberg) y las empresas conjuntas de Sea Transport Alliance (CRETSCHMAR \u2013 NAVIS Seehafen-Spedition GmbH, Noerpel \u2013 NAVIS GmbH) trabajan exclusivamente de acuerdo con las Allgemeine Deutsche Spediteurbedingungen 2017 (\u201cADSp 2017<\/strong>\u201d) (los t\u00e9rminos y las condiciones generales de los transitarios alemanes 2017).<\/strong><\/p>\n

Atenci\u00f3n:<\/strong> La cl\u00e1usula 23 de las ADSp 2017 difiere de la limitaci\u00f3n de la responsabilidad legal citada en el art\u00edculo 431 del C\u00f3digo de Comercio Alem\u00e1n (HGB), limitando la responsabilidad del transporte multimodal, en el cual el transporte mar\u00edtimo est\u00e9 inclu\u00eddo y teniendo en cuenta un lugar desconocido de siniestro, a 2 DEG\/kg y, para el resto, la limitaci\u00f3n de responsabilidad consuetudinaria de 8,33 DEG\/kg adicionalmente a 1,25 millones de euros por reclamaci\u00f3n de da\u00f1os y 2,5 millones de euros por caso de da\u00f1os, pero no menos de 2 DEG\/kg.<\/p>\n

Nuestra cotizaci\u00f3n est\u00e1 basada en sus especificaciones de peso, medidas, tipo de mercanc\u00eda y valor de mercanc\u00eda. Asimismo se tendr\u00e1n en cuenta las tasas y las tarifas actuales y el tipo de cambio. La cotizaci\u00f3n est\u00e1 sujeta a cambios hasta llegar a una conclusi\u00f3n firme. Las reservas de espacio en buques, aviones y veh\u00edculos de nuestra elecci\u00f3n ser\u00e1n efectuadas por nosotros. Los pagos de flete y otros costes deber\u00e1n ser efectuados en euros. Otras divisas ser\u00e1n convertidas en euros seg\u00fan el tipo de cambio del buque. De no ser cotizados, los siguientes conceptos no estar\u00e1n incluidos: la prima del seguro de transporte, los costes de identificaci\u00f3n del contenido y el estado de la mercanc\u00eda en caso de da\u00f1o, la inspecci\u00f3n aduanera, el almacenaje, el env\u00edo de documentos, gastos de comunicaci\u00f3n y gastos excepcionales. El env\u00edo de documentos ser\u00e1 a riesgo del cliente.<\/p>\n

5. Instructions to be followed in case of cargo loss or damage:<\/h2>\n

1. Inspect goods immediately <\/em>
Even if loss or damage is only suspected do not give a clean receipt but mark documents (e.g. shipping documents) by stating extent of damages suspected or noticed.<\/p>\n

When delivery is made by container ensure that the container and its seals or locks are examined immediately by the responsible officials of the shipowners or the carrier. If the container is delivered damaged or with seals or locks broken or missing or with seals or locks other than stated in the shipping documents clause the delivery receipt accordingly stating the assumed loss or damage and retain all defective or irregular seals and locks for subsequent identification.<\/p>\n

2. Secure rights of recovery from third parties.<\/em>
Shipowners, railway, post, lorry owners, other carriers, forwarding agents, warehouses, customs and port authorities must be<\/p>\n

    \n
  • requested to attend a joint survey<\/li>\n
  • requested to certify the loss or damage, and<\/li>\n
  • held liable in writing<\/li>\n<\/ul>\n

    where loss or damage is apparent – before taking delivery of the goods, where loss or damage is not apparent – immediately upon discovery of said loss or damage, at the latest, however, before termination of time limits (e.g. 3 days after discharge).<\/p>\n

    3. Care must be taken to minimize loss or damage and to avoid further loss or damage. <\/em><\/p>\n

    4. Immediately contact the claims survey agent named in the polifcy or certificate of insurance.<\/em><\/p>\n

    On proving substantial reasons the nearest Lloyd’s agent may be called in instead of the claims survey agent named.<\/p>\n

    5. Do not alter conditions and packing of goods before arrival of the claims survey agent unless required by measures as under clause 3. <\/em><\/p>\n

    6. Immediate notice of claim documents must be given to Insurance Company. <\/em><\/p>\n\n\n\n

      Prompt settlement of claims can only be effected by Insurance Company in cases where documents enumerated under clause 7 have been presented to Insurance Company. Immediate presentation to Insurance Company is, therefore, in the own interest of the party claiming damages \/ losses under the policy \/ certificate of insurance issued. In any case the documents mentioned must be submitted to Insurance Company well before expiry of any time limits of carriers etc. as under clause 2 to leave sufficient time for claims against third parties.<\/p>\n
